Department of Justice Response to Freedom of Information Act Request for Document Related to NorthPark Management ADA Settlement

As you regular readers know, I filed a complaint against the folks at NorthPark Center and NorthPark Management based on events which occurred on August 9, 2008.  After three years and four months, NorthPark Management and NorthPark Center agreed in a settlement, signed on November 28, 2011, to bring their facilities into compliance with the ADA.  On November 30th, Carmen Romero informed me of the settlement and asked me to sign a waiver of my rights and accept a $1,000 check from NorthPark Management.  This document was prepared by NorthPark Management's attorneys.  Problem is, I have expended over $9,000 in my own money to push and alternately pull the DOJ in order to get them to enforce the law.  Yet, the DOJ asks me to settle for $1,000 and give up all rights to recover the balance of my out-of-pocket expenses.  I refused.  To add insult to injury, Ms. Romero at the DOJ refused to send me a copy of the settlement reached as a result of my complaint.  So, I have been forced to file a request for the documents through a Freedom of Information Request.  Here is the Department of Justice's reply.  Let's see just how long it takes them to fulfill my request.  No doubt they will need to consult with NorthPark's attorneys to get their instructions, as they seem to be working with NorthPark and against me in this matter. to recover my legal expenses

Please support the advertisers whose fees for making using of my blog page make it possible for my blog, and blogs by anyone else, to contribute to public debate. I do not need the minimal income generated by your "clicking through" these ads to support myself. However, I could never afford the expense of supporting such a blog site on my own and your viewing those advertising sponsors' messages does make this forum available to all. These ads are no security risk to your computer or your privacy for multiple reasons. First, I have absolute and total control over what ads and advertisers appear on my blog. I have nothing to gain from your visiting an advertisers site and finding as a result that your computer is infected or your privacy infringed upon. Second, these ads are placed and serviced by a reputable sales organization - AdSense. They would quickly go out of business if readers who click through the ads they place on this blog became the least bit dissatisfied by the results. Finally, Google and Blogspot.com have nothing to gain from damaging your computer or infringing on your privacy and everything to lose if they do.

  1. Somone should help you find a sympathetic attorney who will assist you in recovering your money. Hard to find one though I expect.

  2. I doubt that will happen. I have yet to find an attorney who thought as much about the meaning of the law as the money to be made from it. I only want my legal fees recovered and I can't think that any attorney, in Dallas or elsewhere, really gives a damn about how these violations of anyone's civil rights, mine included, are degraded by the lack of interest on the part of the legal community to give the law any teeth so to speak. But thanks for the comment. Keep checking back, I am not yet through with NorthPark Center, NorthPark Management, or the idiots at the Department of Justice who attempted to sell me out like a prostitute for $1,000
